László Kövér’s ideas about the ideal democracy: Governance by decree

I really didn’t think that László Köver, president/speaker of the Hungarian parliament, could still surprise me. Yet he manages. Here is his latest.

By way of preface, I should note that there are some commentators who say that one ought not take Kövér terribly seriously. He is just this kind of a fellow. Perhaps his bark is worse than his bite.

Well, I don’t belong to the camp of those who take him lightly. He is the alter ego of Viktor Orbán. He always was. In reminiscences about the early days of Fidesz participants often describe him as the man who had an enormous influence over young Viktor Orbán. Kövér took his sweet time graduating from law school and therefore was four years older than Orbán. According to those who shared their recollections of Kövér in the book compiled by György Petőcz (Csak a narancs volt), Kövér was a cantankerous, hard-to-get-along-with fellow who was utterly devoted, body and soul, first to the college that he, Orbán, and others ran and later to the party. To those who didn’t particularly like him, he was Viktor Orbán’s evil spirit. If Kövér wasn’t around, it was easy to come to an understanding with Orbán. Some even claim that there is a cowardly side to Orbán; if he feels threatened, he is ready to give in. Not so Kövér. He often propped up Orbán, and thus there could be no compromise in the party leadership.

I don’t know whether it was clear to his fellow college students that the man was an ardent nationalist even then. Apparently Kövér’s real interest was in history, not so much in the law. Therefore he attended classes in the university’s history department. His references to modern Hungarian history reveal his deep-seated nationalism, which leads to historical distortion. In the center of his historical universe stands Trianon. I suspect that in this respect Kövér didn’t change much. As far as his politics are concerned, he did change from ardent socialism to fierce anti-communism with a good dose of right-wing extremism mixed in. On his way from extreme left to extreme right he never managed to feel at home in a democratic republic. The very idea of democracy is alien to the man, as we will see from his latest pronouncement.

Yesterday afternoon Kövér gave an interview to Aréna, a political program on Inforádió, a right of center radio station.  In it he covered many issues dealing with the Hungarian parliament. During the course of the interview he said: “I would find it normal, quite independently from what kind of governments we will have in the next few years, if the parliament would lay claim only to the creation of the most fundamental legal guarantees and would otherwise hand over its mandate to the government for the next four years.” When pressed, he explained that this would mean a kind of governing by decree. In his opinion it is no longer necessary to have a government whose functioning depends on laws enacted by parliament. The present system was worked out in 1989-1990 because of the fear of a return of dictatorship. This fear was justified until 1998. But by now this danger is gone.

An incredible statement demonstrating a complete ignorance of the role of parliament in a democracy. The parliament enacts laws not because it is “afraid of dictatorship” but because the representatives of the electorate thus have the opportunity to discuss the laws proposed by the government and can have a measure of control over them.

Kövér also has peculiar views on the essence of democracy. If there is no fear of dictatorship, the government can do whatever it pleases. Earlier on this blog we discussed Kövér’s willingness to get rid of the Constitutional Court because then, he claimed, parliament would have the final, irrevocable say in matters of policy. But now he would be willing to emasculate the parliament of which he is the speaker and empower the government to govern by decree.

Kövér also seems to believe that once democracy is firmly established it needs no improvement or even much oversight. According to this static view, the democratic political system cannot slide back into dictatorship. It would be amusing, were it not so sad, that Kövér believes that this perfect state of democracy arrived in 1998, when Fidesz won for the first time.

I doubt that Kövér learned much about modern Germany while dabbling in history. Otherwise he might have been more cautious in advocating governance by decree. It was in March 1933 that an amendment to the Weimar Constitution took effect which gave power to Chancellor Adolf Hitler to enact laws without the involvement of the Reichstag. The act stated that this arrangement was to last four years unless renewed, which subsequently happened twice. This so-called Enabling Act (Ermächtigungesetz) gave Hitler plenary powers and made him the dictator of Germany. What did Hitler himself say at the time of the enactment of the Enabling Act? It will sound familiar to us: “after the methodical destruction of the nation” the age of renewal has arrived. “The most important question is the handling of the short- and long-term foreign indebtedness. One must save the German peasantry, and the national government will also assist the middle classes.”

The resemblance between the German Enabling Act and what Kövér proposed in this interview was first picked up by János Avar and seconded by György Bolgár on ATV’s UjságíróKlub last night. It has since been repeated by many bloggers. It is one of the most frightening suggestions I have heard in the longest time. And let’s not fool ourselves. This is not some kind of off-the-cuff remark that Kövér hasn’t thought through. Already in February he was talking about giving more power to the government at the expense of the parliament.  In the interview he complained about the current practice which requires that every piece of legislation be enacted by the legislature and long debated. What a bore! Let’s cut out the middle man.

MSZP and Együtt2014-PM made a joint statement in which Gordon Bajnai and Attila Mesterházy found it “appalling that the president of the Parliament wishes to enlarge the authority of the government at the expense of the Parliament.” They considered the very suggestion “threatening.”

I guess the Fidesz leadership decided that Kövér revealed more of the party’s plans than was advisable and immediately announced that naturally the opposition completely misunderstood what Kövér was getting at. Gergely Gulyás, the constitutional expert of Fidesz, in fact claimed that Kövér said the exact opposite of what we all heard from Kövér’s mouth. In fact, said Gulyás, he was talking about “the extension of the opposition’s rights and the greater oversight of the government by the parliament.”

Some observers, including one of our commenters, suggest that Fidesz here is working on a devilish plan that would allow the party and Viktor Orbán to continue their present policies in case after 2014, as they suspect, they don’t have a two-thirds majority in parliament. By curtailing the powers of parliament and enabling the government to rule by decree, the unfettered governing by the third Orbán government could go on despite a stronger parliamentary representation by the opposition. This hypothesis sounds plausible to me.

Of course, if the opposition wins, the big loser in this scheme will be Fidesz. But Viktor Orbán and his alter ego like to gamble. If I were an opposition politician I would double, triple my efforts to unseat this government. Otherwise Hungarians may end up living in Fidesz’s perfect democracy, known to the rest of the world as a dictatorship.

Fidesz’s success and the public’s ignorance of democratic principles

I guess the real test of a good opinion piece is whether the reader finds it thought provoking. Whether while reading the piece dozens of  examples, questions, and ideas come to mind. I must say that I don’t have this experience very often, but this morning I did thanks to an article by Árpád W. Tóta entitled “A fideszes áfium ellen való orvosság.” My mind immediately started racing (some might say wandering), but as it turned out I wasn’t too far from the main thrust of Tóta’s argument.

First I stopped at the word “áfium” in the title.  My high school years came back to me. All those who finished Hungarian high school learned something about Miklós Zrinyi (1620-1664), ban (governor) of Croatia, general, poet, politician, writer of political treatises. He wrote a political pamphlet entitled “A török áfium ellen való orvosság” and, although I don’t remember ever reading a single line from this work in school, we did learn the pamphlet’s title. But there was one rather serious problem. We had no idea what the word “áfium,” an archaic word, meant and our Hungarian teacher never bothered to enlighten us. It was only years later that I found out that “áfium” meant “opium” and that the title actually meant “Medicine against the Turkish opium.”

From “áfium” I made a mental leap to the deficiencies of Hungarian education and found myself on the same wave length as Tóta, who complained in the body of his article about the ignorance that allows a million and half Hungarians to be unquestioning followers of a false messiah. Tóta believes that “the medicine against the Fidesz opium” lies in enlightenment, in education, in learning about democracy, learning about the world.

Tóta is right when he claims that those who find Fidesz’s message and practices repugnant often think that Viktor Orbán’s slavish followers are simply stupid. No, he says, they are just ignorant–and they lack intellectual curiosity. I would change the order of deficiencies here. Without intellectual curiosity a person will never acquire the information necessary to make intelligent choices. And intellectual curiosity is in short supply in Hungary. For instance, the number of Hungarian adults taking continuing education courses is the lowest in all of Europe.

Tóta blames the eight years of socialist-liberal governance for allowing a generation to grow up without ever acquiring the rudiments of democratic thinking. As a result 17% of Hungarian college students believe the drivel of Jobbik. Tóta suggests that once Fidesz is gone it will be time to transform the newly adopted compulsory hour of morality and religion to “civics.” As he jokingly says, “the framework is given; one just has to change the textbooks.”

Once I got this far I recalled Ferenc Krémer’s latest article on Galamus about “Teaching democracy, the German example.” Krémer naturally mentioned the German children’s show which teaches the pillars of democracy, like an independent judiciary, freedom of the media, and freedom of assembly. It was on this show that German children learned about all those undemocratic practices the Orbán government introduced. Naturally Orbán was outraged and called the show “brainwashing,” something he would never allow to appear on Hungarian public television.

My guess is that a lot of liberal and socialist opponents of the Orbán government would agree with Tóta and Krémer that democratic thinking must be taught, preferably at a young age. But many of the same people find the European Union’s efforts at curbing smoking unacceptable. It is brainwashing, they say.

So, let’s see what brainwashing means. It has two meanings: (1) intensive, forcible indoctrination, usually political or religious, aimed at destroying a person’s basic convictions and attitudes and replacing them with an alternative set of fixed beliefs, and (2) the application of a concentrated means of persuasion, such as an advertising campaign or repeated suggestion, in order to develop a specific belief or motivation.

Surely, neither the German children’s show teaching young kids about democratic thinking nor the campaign against smoking would fall into the first category. There is no question of forcible indoctrination here. Instead, both use persuasion in order to develop a specific belief or motivation. In the first instance to develop a belief in democracy and in the second to reinforce one’s motivation to quit smoking. Both are for the common good, I think. Yet a lot of confusion as well as genuinely conflicting opinions surround the question of influencing public opinion. The Nazis in Germany didn’t have to force people to follow the Führer. A concentrated means of persuasion was enough. Or we condemn the tobacco companies’ advertising practices that encouraged smoking but laud the efforts of governments to curb smoking, although both fall into the category of persuasion by social means.

The subject of brainwashing and persuasion has a large literature, but I like one simple description of brainwashing: “someone else is thinking for you.” This is unfortunately very much the case with nonthinking Fidesz followers. Whatever future Hungarian governments do to ensure a better educated public, they must put the emphasis on independent thinking and a broader knowledge of the world. It also might not be a bad idea to teach children the meaning of “áfium” and, while they are at it, tell them what Zrínyi’s work is all about.

Viktor Orbán’s answer to the Tavares report

As soon as the vote in the European Parliament went against the Hungarian government, Viktor Orbán announced that a resolution will be introduced for the Hungarian parliament to adopt that will condemn the Tavares report.

And indeed, by this afternoon the proposed text of the resolution was already on László Kövér’s desk. The bill is signed by three Fidesz members of parliament: Antal Rogán, the leader of the Fidesz caucus, Gergely Gulyás, one of his deputies and the alleged constitutional expert of the party, and Máté Kocsis, mayor of District VIII and a very active young member of parliament.

This afternoon I heard an interview with Gergely Gulyás, in the course of which he was asked whether the idea for the resolution came from Viktor Orbán. Gulyás, who is one of the few Fidesz politicians for whom lying doesn’t come easily, paused. It was a very long pause. Eventually he found the right words: the prime minister can certainly identify with it.

What we must keep in mind is that the resolution comes from Fidesz the party and, as you will see, is at  least in part addressed to the government. So, strictly speaking, Viktor Orbán, the party chief, is asking Viktor Orbán, the prime minister, to do certain things.

Decree of Parliament on the equal treatment due to Hungary

1. We Hungarians entered into the family of European nations by establishing a state and adopting Christianity.

We Hungarians often stood up for European values. There were times when we defended these values with our blood against attacks from outside. In 1956 we armed ourselves against the communist dictatorship. In 1989 we contributed to unifying Europe with the demolition of the iron curtain.

We Hungarians entered into the European Union of our own free will.

We did that in the hope that we would join a community based on law, justice, and freedom.

We Hungarians  do not want a Europe where freedom is limited and not widened. We do not want a Europe where the larger ones abuse their power, where national sovereignty is violated, and where the smaller have to honor the larger. 

We have had enough of dictatorship after 40 years behind the iron curtain.

We Hungarians have always respected the desire of European Union institutions for dialogue, and we have always been ready for reasonable compromises. 

Therefore, we rightly expect the respect and equal treatment due to Hungary from the European Union’s institutions.

We expect the European Union to respect the rights that we acquired after our accession just as it would respect those of any other country. 

The Parliament of Hungary is surprised that the European Parliament passed a decree that it had no right to pass, that exceeded its jurisdiction. The European Parliament made demands, introduced new procedures, and created institutions that violate Hungary’s sovereignty as guaranteed in the fundamental treaty. 

With this decision the European Parliament went against basic European values and led the Union on a dangerous path.

The Hungarian Parliament is further worried by the undue influence of business interests that underlie this abuse of power.

Hungary is reducing the cost of energy paid by families. This may hurt the interests of many European companies that for years have had windfall profits from their monopoly in Hungary. It is unacceptable that the European Union tries to influence our homeland to further the interests of these companies.

The Hungarian Parliament believes that Europe is in danger if the interests of multinationals are realized at the expense of the rules laid down in the fundamental treaty.

Today we adopt a resolution to defend Hungary’s sovereignty and the equality of Hungarians in the European Union.

We call on the Hungarian government not to give in to the pressure of the European Union, not to let the nation’s rights guaranteed in the fundamental treaty be violated, and to continue the policies that make the lives of the Hungarian people easier.

2. This decree of Parliament will enter into force the day after its publication.”

The embellished historical commonplaces that introduce this resolution are to be expected. Hungarians always drag them out when they want to prove their European roots and vaunt their accomplishments in defending Europe from the eastern peril.

What is much more interesting is the government’s attempt to establish a connection between the Orbán government’s lowering of energy prices and the Tavares report which, after all, is about the Hungarian government’s transgression of democratic norms and not about economics. This alleged connection is ludicrous in and of itself, but if we consider that Rui Tavares has been working on this report for at least one and a half years and the Orbán government came up with the political masterstroke of lowering energy prices only a couple of months ago, it should be clear to everybody that there is absolutely no link between the two.

The attempt to cast business interests as a motivating force behind the Tavares report and its acceptance is more than tenuous. Support for it came largely from the left–the socialists, greens, and liberals who are not exactly known for their support of big business. The right- and right-of-center parties are by and large more pro-business. And a majority of their representatives stood by Viktor Orbán.

In his speech in parliament today Orbán again attacked the multinationals and the banks, but some Hungarians, it seems, want more than bellicose talk. Here are the first signs.

Today the verdict was handed down in a case that has been been in and out of court for two and a half years.  The plaintiff took out a foreign currency loan which he now finds impossible to pay back due to the weakening of the Hungarian forint. He claimed that he shouldn’t have to pay the loan back because the bank did not mention the bid-ask spread in the contract. Two lower courts decided in favor of the plaintiff. The case then moved up to the highest court, the Kúria. For a number of days demonstrators have stood in front of the building, waiting in a rather ugly mood. The verdict finally came: OTP, Hungary’s largest bank, is not liable. The plaintiff will have to pay his loan back.

The crowd outside was outraged at the verdict. One would have thought that the crowd would go OTP headquarters to vent their anger. But no, they headed toward Viktor Orbán’s private residence in Buda. One could see gallows and red-and-white striped flags (the favorite symbol of the Hungarian extreme right), interspersed with the Hungarian tricolor.

So, if Orbán thinks that by whipping up anti-business sentiment he will gain great political advantage, he might be mistaken. These dissatisfied people, it seems, blame him for being unable to “solve their problems.” After all, he promised that he would take care of those hundreds of thousands of people who lost their homes as a result of the collapse of the Hungarian forint over the last few years.

As for Viktor Orbán’s speech in parliament, he didn’t add much to the content of the proposed resolution, except for getting close to calling those Hungarian MEPs who voted for the Tavares report traitors. However, Attila Mesterházy in a forceful speech condemned the Orbán government, the prime minister’s “business interests,” and his “majoritarian rule.”

The Fidesz back benchers are the noisiest ones on the right and unfortunately they are also ignorant. For example, when Mesterházy reminded Viktor Orbán that when he was in opposition he went so far as to ask the European People’s Party to use its influence in the European Union to stop any payment to Hungary, they tried to drown out Mesterházy. I’m sure most of them thought that this was a lie. It was, however, absolutely true. Orbán rarely if ever thought about collateral damage to the country as a whole in his relentless attacks on the socialist-liberal government.

In addition, Attila Mesterházy and Gábor Harangozó on behalf of MSZP turned in amendments to the proposed resolution. Since there is no chance of Fidesz ever accepting any amendment coming from the opposition, by now parties on the left write these amendments in jest. It is an amusing piece that is worth reading.

The European Parliament’s debate on Hungary

I spent almost three hours watching the debate in the European Parliament on the Tavares report. We discussed this report at length at the time of its passage in the LIBE Commission of the European Parliament. In addition, I published Rui Tavares’s letter to the Hungarian people both in English and in Hungarian. So, the readers of Hungarian Spectrum are aware that the report is a thoroughly researched document that in many ways echoes the findings of the independent judges of the Venice Commission of the Council of Europe.

I found two good summaries of the debate, both in Hungarian. One appeared in Népszabadság and the other on the new Internet website called 444! But it is one thing to read a summary and another to see the debate live. Just to watch Viktor Orbán’s face was itself educational. Sometimes he looked vaguely amused, but most of the time his smile was sardonic. Who can forget that disdainful expression on Orbán’s face when one of his critics, Guy Verhofstadt, the leader of the liberals in the European parliament and former prime minister of Belgium, mentioned the name of  György Konrád, “the great Hungarian writer”? And when he heard something he didn’t like, Orbán raised his eyebrows and shook his head in disbelief. He considered all criticism utterly baseless and, through body language and facial expressions, made no secret of it. It’s too bad that most of the people in the chamber didn’t see all that since Orbán sat in the front row.

Unfortunately the camera didn’t show Orbán when several people tried to explain to him that his concept of democracy is peculiar. He believes in the “dictatorship of the majority” or “majoritarian rule.” Verhofstadt even invoked John Stuart Mill’s words on the subject in his work On Liberty. In fact, one of the major criticisms centered around the nature of democracy and whether Hungary can still be called a democracy. If one were to ask Verhofstadt he would say: “No, Hungary is not a democracy anymore but ‘demokratúra’ as György Konrád called it.” Several other critics agreed with Verhofstadt although they may not have been so explicit.

A second core topic was the question of freedom and the Orbán government’s “war of independence” against the European Union. Several people expressed their bafflement at the very idea of defending the country from a Union to which Hungary belongs. Actually, here again two worldviews clashed. The one held by Viktor Orbán and his entourage maintains that nation states are the only legitimate formations and that they shouldn’t be superseded in any way by a supranational entity such as the European Union. If one holds this view, as Orbán does, then it is perfectly understandable that he defends his nation against the encroachment of the European Union. The problem is that Hungary joined the European Union of its own volition and thereby its government is obliged to follow EU rules. Orbán attempts to resolve this apparent conflict by claiming that the Union is overstepping its authority, and therefore he has every right to resist its attempt at a “guardianship” that he will never accept.

Another important topic of discussion was Orbán’s interpretation of the criticism of his government as an attack on Hungary and the Hungarian people. Several critics rejected this view, making it clear that their criticisms are directed against the Orbán government and not the Hungarian people. In fact, some of the speakers argued that in their opinion it is the Hungarian people who must be shielded against the authoritarian behavior and laws of their own government.

As for Viktor Orbán, he had two opportunities to speak. At the beginning, right after Rui Tavares and Juán Manuel Barroso, and at the end, just before the leaders of the various parliamentary caucuses could answer him. In his first speech he was quite polite and a great deal less aggressive than is his wont. However, after listening to the debate where the Christian Democratic and Conservative voices were drowned out by speeches delivered by the liberals, socialists, and greens, Orbán returned to his true self. As Gabriella Zimmer (a German socialist) said, Orbán didn’t come to Strasbourg “to debate”; he came to express his anger at what he considers to be interference in Hungarian domestic affairs that are within the sole jurisdiction of the Hungarian government, parliament, and courts. He finished his speech with a refusal to accept tutelage from Brussels. For good measure he accused them of  having double standards and of defending the multinational corporations and banks. I had the feeling that by that time Orbán believed that he had nothing to lose. It was no longer necessary to try to mollify the EU parliamentarians. No matter what he does, I suspect he reasoned, the vote will go against him.

And a few more words about the performance of Fidesz and Jobbik MEPs. What can I say? It was embarrassing. Szájer’s comments were the most outrageous. He was not on the list of official speakers but he asked to be recognized perhaps three times. In the first instance he outright lied when he announced that foreign investment was never greater in Hungary than in the last two or three years. Then he claimed that the members of the European Union are afraid of the truth and that’s why they don’t want to give Orbán the opportunity to speak. Both Verhofstadt and Martin Schulz, the president of  the EP, corrected Szájer. After all, they were the ones who asked Viktor Orbán to come to the plenary session of the European Parliament. But that was not enough for Szájer. He retorted that even in Stalin’s show trials more time was allotted to the accused than to the accusers. Well, that’s when Martin Schulz’s patience ran out. He reprimanded Szájer for making any comparison between Stalin’s show trials and the European Union. But Szájer is not the kind of guy who knows when to stop. He got up again and tried to explain away his unfortunate remark. He repeated his reference to Stalin’s show trials and added that it was only the time limit that he had in mind. Schulz was not impressed and rebuked him again. Szájer did a disservice to the Fidesz cause.

Kinga Gál, another Fidesz MEP, was one of the official speakers. She didn’t fare any better than Szájer. In her speech she challenged the democratic nature of the European Parliament that voted in committee for the Tavares report. Schulz gave her a piece of his mind. He told her that it is impossible to claim that majority rule in Hungary is perfectly legitimate while questioning the democratic nature of majority rule in the European Parliament. After all, the majority of LIBE members voted for the Tavares report.

The third Fidesz MEP, Ágnes Hankiss, asked to raise a “question.” It turned out that she in fact planned to deliver a lecture on the injustices of the Tavares report. Schulz interrupted her, saying that she was abusing the privilege of posing questions. Hankiss tried to go on but was stopped.

And if that weren’t enough, we had the privilege of listening to Krisztina Morvai (Jobbik) twice. No EU parliamentary caucus accepted Jobbik and therefore they sit as unaffiliated members. Thus she had the privilege of speaking twice, just as the other leaders of the various parties. She sported a blouse adorned with Hungarian folk motifs and held up a sign reading “HUNGARY ≠COLONY.” Otherwise, although Orbán emphasized that he is the one who is most fiercely attacked by the far-right Jobbik, Morvai defended Fidesz and its policies all the way while accusing Viviane Reding of meddling in Hungarian affairs. Her second speech was especially remarkable. She recalled her days working with battered women who often thought that they could change their abusive husband’s behavior by pleasing him, working harder, and being the best of housewives. But eventually when the husband’s behavior remained the same, they came to the conclusion that there was only one remedy: divorce. So, Hungary should pack up and leave the Union if this abuse continues. After that ringing defense of Fidesz it will be difficult for Orbán to maintain his fierce opposition to the far right. After all, they speak the same language and Jobbik fights alongside Fidesz for the “honor of Hungary.” Frank Engel (Luxembourg EPP member) sarcastically remarked immediately afterwards that he hoped that “Ms Morvai has not just offered to go into coalition with Fidesz.”

The vote will take place tomorrow at 11:30 European time or 5:30 EDT. I will be watching.

It’s time to get back to the present, which is a great deal  less upbeat than the days just before the Hungarian government allowed the East Germans to cross into Austria. Those days were full of hope. The Round Table Negotiations were winding up and within a few days the establishment of the Fourth Republic was declared.

Today the mood of the country is outright gloomy. The economy is languishing and the opposition is in disarray. And yet one must move ahead. One helpful sign: a discussion about how the wounds the Orbán government inflicted upon the democratic institutions of the country can be healed is going on in earnest on the Internet. Zsófia Mihancsik, editor-in-chief of Galamus, was the one who initiated a series of articles on the topic. Up to date eleven pieces have appeared; I will compare the last two. Yesterday Ferenc Gyurcsány wrote and today Attila Mesterházy.

My first impression was that their ideas on the restoration of democracy in Hungary run along very similar lines. In my opinion, if it depended only on these two men, MSZP and DK could come to an understanding on practically all the important issues in no time. I don’t know whether Gordon Bajnai will join these two politicians and outline his own ideas on Galamus, but from what I know about E14-PM ‘s view of the future without Viktor Orbán it is quite different from those of Gyurcsány and Mesterházy.

So, let’s see what they agree on. Practically everything. Neither of them believes in any kind of compromise with Viktor Orbán’s party. Gyurcsány, as is his wont, puts it in stark terms. He considers the Orbán government illegitimate and illegal. Illegitimate because it didn’t receive a mandate to change the basic democratic structure of the country and lead it toward autocracy. It is illegal because it strives toward the acquisition of exclusive power. He also finds the 2012 Constitution illegal and illegitimate.

Neither Gyurcsány nor Mesterházy thinks that the 2012 Constitution can be left in place, but while Gyurcsány considers a two-thirds majority necessary to write a new constitution, Mesterházy perhaps  a little bit more realistically thinks that some kind of legal possibility exists that might solve the problem. For example, wide societal support for a new constitution that could force a referendum on the issue. That would require some very clever legal finagling given the current restrictive provisions of the Hungarian constitution.

Mesterházy spends some time distinguishing between Fidesz as a party and the Fidesz voters. He is convinced that the majority of those who voted for Fidesz in 2010 did so in the hope that Viktor Orbán would ensure them a better future but that by now they are disappointed in their man and his government. I disagree with his assessment of the current state of affairs. I don’t think that most Fidesz voters are disappointed. Yes, a lot are, but the so-called hard core is unshakable. In my opinion Mesterházy is far too optimistic when he writes about the eventual attrition of Orbán’s followers. Past experience tells us that 1.5 million people will always vote for Fidesz no matter what. Gyurcsány doesn’t address this problem.

Both think that political appointees must be relieved of their jobs because otherwise the new government would be totally powerless to make the changes necessary for the restoration of democracy. Gyurcsány specifically mentions a few crucial appointments in the judicial system such as Fidesz nominated judges to the Constitutional Court, new high-level judges, and the supreme prosecutor. He also thinks that many of the newly appointed civil servants most likely will have to be let go because by now the whole civil service is completely politicized. Unfortunately neither of them tells us how he would be able to accomplish this legally.

Both agree that the illegal concessions, be they land leases or tobacconist shops, must be reevaluated and if necessary revoked. As for the tobacco state monopoly Gyurcsány specifically calls for an immediate abrogation of the law. Let’s open the tobacco market, he says, and let the new Fidesz owners compete on a level playing field.

Gyurcsány is quite specific about which Fidesz changes he would leave alone. He would allow municipalities to choose whether they want to have their schools back or whether they are satisfied with having local schools under centralized state administration. One could even make an argument to leave hospitals in the hands of the state. He would not abolish the new administrative unit, the járás, although one most likely would give them autonomy instead of centralized state oversight.

These two men could easily see eye to eye. EP14-PM is a different matter. Bajnai’s team are ready for a compromise with Fidesz, and they think they could live with the current constitution after a little fiddling with it. On this point both Mesterházy and Gyurcsány are clear: there can be no compromise with Fidesz. This is such a basic disagreement of principle that it will be difficult to resolve. And, by the way, E14-PM again lost a couple of percentage points according to the latest Tárki poll that was released only today. The postponement of the negotiations in the hope of gaining strength didn’t bring the expected results. On the other hand, MSZP gained a couple of percentage points.

How to rebuild democracy in Hungary? According to some, not by compromise with Fidesz

As I mentioned yesterday, there were two topics suggested by readers and I agreed that they were interesting and definitely worth spending time on. After tackling two surveys on Hungarian societal attitudes we can now turn to the question of “What will happen, what should happen after Orbán?” posed by Zsófia Mihancsik, whose writings have appeared more than once on this blogHer latest contribution is  a series of questions she thinks the democratic opposition should discuss even before the election campaign. At the moment the various opposition parties and groupings agree on one thing:  Orbán’s regime must be removed. However, some very important decisions must be made and agreed upon. It is for this reason that she as editor-in-chief of Galamus initiated a series of articles that might assist those whose job it will be to work out a common platform necessary for setting up a successful and lasting coalition.

The first question is: “Do we have to reach a compromise with Fidesz after the party’s loss of the 2014 elections?” In practical terms that means that the democrats must forget about all “the political and moral crimes that had been committed by Fidesz  in opposition and in power.” One can make a case for such compromise by pointing out that, after all, the voters of Fidesz represent a certain portion of the electorate.

If the decision is to seek a compromise, one must determine whether this compromise should be with the party itself, with its voters, or both. Moreover, how much should the democratic forces be willing to pay for such a compromise? And one ought to ponder whether such a compromise would actually achieve the desired result of political and social tranquility.

But if it becomes obvious that no compromise is possible either with Fidesz or its voters, then how should the new political leadership handle the coming conflicts? Can they in a democratic regime ignore a party that received the votes of many and is represented in parliament?

What should they do with “the products of Fidesz’s rule–the new constitution and all those new laws?”  These laws were enacted in order to build a centralized, state-dominated regime serving only the needs of an autocracy. Would it be enough to whittle away at them or, like Orbán, should they start everything anew and develop an entirely new regime? “In other words, can one build democracy on a set of laws that were designed to build autocracy?”

What should be done with party cadres who masquerade as experts? Should they be replaced? And there is the question of those who were appointed for nine or eleven years. What should be done with those people who, thanks to Fidesz, received land or tobacconist shops? What about the nationalized schools? Does one have to face the fact that these mostly illegal changes cannot be undone and that one must live with them? And if yes, what are the consequences?

More or less these were the questions that Mihancsik posed in her article.

The first answer to some of these questions came from Ferenc Krémer. You may recall that he was one of the early victims of the Orbán regime when he lost his job as professor of sociology at the Police Academy. He was far too liberal for that place. I will summarize the article in greater detail, but his message is crystal clear: there is no way of making a compromise on any level because one cannot build  democracy on undemocratic foundations.

Can one build democracy by undemocratic means or does one need consensus? Krémer’s answer is that neither road will necessarily achieve the desired end. After all, the 1989-90 regime change was based on consensus and yet it didn’t produce a lasting democratic regime. At that time consensus was easier to reach because all segments of Hungarian society desired the the same thing, the establishment of a democratic regime. But today the situation is different because, although “all democratic opposition forces assume that there is need in this country for democracy, the fact is that almost as large a segment of society gladly settle for a dictatorship.” Thus the reintroduction of democracy in Hungary at the moment, unlike almost fifteen years ago, does not have a solid societal foundation.

If the preconditions of a general desire for democratic change are missing, can one substitute for them concessions to those whose ideal is not exactly democracy? In Krémer’s opinion one can’t. In the past, no concessions to a Viktor Orbán-led Fidesz ever followed by any tangible result of cooperation. Moreover, the election will be decided by the now still undecided voters. In Krémer’s opinion “it is a grave political mistake to consider the undecided voters as disillusioned Fidesz followers and to talk to them as if they had anything to do with what happened in the Fidesz era. … It is very probable that one cannot offer anything to the Orbán voters that would change their minds and therefore one shouldn’t even experiment with such an approach because it only confuses the anti-Orbán voters.”

The democratic opposition first and foremost must decide whether Orbán’s regime is a democracy or not because “autocracy will remain with us as long as its institutions and its culture exist and function.” If the answer is that, yes, it is a democracy, then both the institutions and the people populating them can remain in place. In this case, in Krémer’s opinion, there will not be democracy in Hungary even after the fall of the Orbán regime.

Krémer then outlines a series of possible compromises that could be offered to Fidesz. What Fidesz institutions should be left intact? The Media Council?  The current system of public works? The “orbanization” of state lands? The national tobacconist shops? The nationalized and centralized school system? The militarized police? The Anti-Terrorist Center (TEK)? Forcing experts into retirement? Which ones?

What about some of the newly enacted laws? “Vote for which one you would like.”  The new labor law? The Basic Law, especially with its fourth amendment? The law dealing with the police? The law that dispensed with local autonomy? The law on churches that discriminates against some religious communities? Or what about the law in the making that would sanction school segregation?

What can they offer to the “servants of dictators”? Should they follow the policy of Imre Kerényi and György Fekete, commissars of national culture, or the views of the historians of MTA who decided that no György Lukács or Vladimir Mayakovsky can have streets named after them? Should one say that there is agreement regarding Fidesz’s concept of family or that one can believe in God in only three ways? “Yes, we could say it but then we wouldn’t be who we are.”

In brief, Krémer is unequivocably against any compromise. Naturally one could argue with his views, but his reasoning, in my opinion, is sound.

A couple of weeks ago I wrote a post on public opinion research in the Kádár regime. There was little reader response to it, most likely because a few hours later on the same day I published the speeches of Péter Feldmájer and Ronald S. Lauder at the Plenary Assembly of the World Jewish Congress in Budapest. I suggest that you take a look at it because today I’m returning to the subject.

If I were living in Budapest I would have access to the Open Society Archives at the Central European University where these old  public opinion poll results are stored. But since I don’t live there I have to rely on a summary of one of these sociological studies that appeared in Origo. The study is from 1989; it seeks to understand the reasons for the popularity of the Kádár regime. The Origo journalist picked this particular year because by then, very close to the anticipated regime change, people had little reason to worry about any possible consequences of their answers.

As a point of reference, in 2001 53% of Hungarian adults thought that the years between World War II and the change of regime in 1989 were the happiest time in Hungarian history. By 2008 62% thought so.

According to a study right after the death of János Kádár (July 1989), 50-60% of adults judged Kádár’s role in Hungarian history in a positive light. Moreover, this was the opinion not only of people with minimal educational attainment but of highly educated people as well. When asked what they liked about Kádár they pointed to his modest, puritanic lifestyle and his informality. 87% declared that their impression of him was always positive. They considered him “one of the great benefactors of the Hungarian people” and “the greatest personality in Hungarian politics.”

What did people appreciate in the old regime? That education and health care were “free” and that the state provided pensions for everybody. People insisted that all these benefits should remain even after the regime change “despite the demand for a multi-party system and a market economy.”

The respondents appreciated the steadily rising living standards, especially noticeable in the 1970s after the introduction of the 1968 economic reform (New Economic Mechanism). In 1987 the sociologists asked people what conveniences they expected to be part of their everyday lives. Well over 90% of the population took it for granted that they would have bathrooms, ready hot water, and a refrigerator. 71% lived in apartments with central heating; almost 60% had automatic washing machines and record players and took family holidays. But only 44% of the families had a car or a colored television set. And getting a telephone line was close to impossible. Only 37% of the families had telephones.

When the Horn government was forced to introduce an austerity program in 1995 (the so-called Bokros-csomag, named after Lajos Bokros, minister of finance) it cost the socialists dearly. In 1998 they lost the election. Viktor Orbán, the new prime minister, promptly announced that every family should have “three rooms, three children, and four wheels,” meaning a car. He was appealing to the Hungarian yearning for a better, more comfortable life.

The later Kádár years were marked by an understanding between the rulers and the ruled. MSZMP and the state would leave the population more or less alone; in exchange for that privilege, the population would give up its ability to exercise political rights. “This compromise for twenty years was a success,” the authors of the study concluded.

In December 1989, that is, after the establishment of the Third Republic on October 23, the team of sociologists asked the respondents what issues would determine which political party they would vote for. They had to list these issues in order of importance. This is the list the group as a whole ended up with: (1) living standards, (2) freedom, (3) independence,(4) democracy, (5) equality, (6) socialism, and (7) capitalism.

The compromise between the rulers and the ruled in the Kádár era made a lasting impression on the Hungarian population. Nostalgia for the Kádár regime is not only growing among those who experienced it firsthand but is being “inherited” by those who were either small children before 1990 or not even born by then. And their priorities are not all that different from the priorities of the respondents in 1989.

Freedom was never the centerpiece of their demands. That pretty well explains the fact that, although the current government has severely limited the democratic rights of the people, there is no great resistance. Fidesz’s popularity in the last two years or so hasn’t dropped  all that much. But if the Orbán government is unable to raise living standards it might find itself in trouble. And if people wake up to the widespread corruption and visible signs of ill-gotten wealth, there might be a change in public sentiment. Kádár won the hearts and minds of the people in part by not being ostentatious. So, if I were Viktor Orbán I might dial back some of those projects that set the prime minister and his coterie of friends apart from the rest of the population. A private football stadium might be too much. Or those tobacconist shops that can make families millionaires. The “have-nots” rarely believe that the “haves” deserve all their toys.

If the economy doesn’t turn around, there will be nothing to give to those who expect a visible improvement in their standard of living.  Then we might see a change in the present acceptance of Viktor Orbán’s growing dictatorial governing style. The question is when the patience of the Hungarians with their mindset inherited from the Kádár regime will run out.

George Orwell in Budapest: The new surveillance law

When faced with the task of writing a post my usual problem is that I have far too much material. On any given topic there can easily be 50-60 news items and opinion pieces. Well, that’s not my problem today. I simply can’t understand this silence about the new law on the surveillance of top government officials, especially when according to Máté Szabó, ombudsman for basic rights, and several other human rights organizations the law is unconstitutional.

Who are the people who will automatically be subjected to surveillance? The bill insists that the new bill on national security does not extend the circle of those who must undergo this procedure. According to the Hungarian-language description of the bill, the high officials who must agree to surveillance are cabinet ministers, undersecretaries, deputy-undersecretaries, government commissioners and commissioners appointed by the prime minister, heads of independent government organizations, heads of government offices handling the official business of citizens, high officials of parliament, the head of the Office of the President, ambassadors, consuls, chief of the general staff, generals, high police officers, CEOs of state companies, members of the national security offices, member of the counterintelligence, members of the parliamentary committee on national security, and even the ordinary parliamentary guards recently appointed.

So, if this surveillance bill does not affect more people than the earlier one why is everybody up in arms? One big difference is that earlier bill stated that once a person was found reliable and received security clearance he would not be the object of further surveillance. Now this provision has changed. As Fidesz’s brief announcement said, “surveillance will be continuous.” Twice a year for at least thirty days each time the government can listen to these people’s telephone conversations, search their houses, and read their correspondence. These surveillance measures would also extend to their family members. Moreover, the number of people who would have to go through this continuous clearance procedure might grow in the future because the bill contains a paragraph that allows the authorities to change the parameters by decree. That is, without amending the bill.

According to the new bill, it will no longer be necessary to get a court order to gather secret information. And there is no possibility of appeal for the wrongfully accused. Once someone  is found guilty by the Alkotmányvédelmi Hivatal (AVH, what an unfortunate name since its abbreviation is practically identical to the notorious ÁVH, Államvédelmi Hatóság) he can immediately be fired. No cause need be given.

But let’s go back a step to the questionnaire these top officials must fill out. Some of the questions are pretty routine. For example, those about alcohol or drug consumption. The Hungarian questionnaire also delves into people’s sex lives, asking them about their extramarital affairs. Another peculiarity of the bill is that the ongoing security clearance/surveillance also extends to the official’s family. So, the spouse of a high official will have to answer the same kinds of questions.

One especially objectionable item on the questionnaire is the official’s private connections with foreign nationals. Who is considered to be a foreign national? Is a German citizen a foreigner? Both the Hungarian and the German are citizens of the European Union. What about relatives living in the neighboring countries? Or Internet connections via social media? After all, some members of the government write blogs or are busy on Facebook and Twitter. Does such a link to the outside world constitute a national security risk?

A few weeks ago there was great hilarity in opposition circles when two very ignorant Fidesz members of parliament suggested that people who were members of the communist party or KISZ, the communist youth organization, before 1990 should be considered security risks and thrown out of their jobs. Well, if that had been adopted, they could have started with Viktor Orbán himself, followed by János Kövér,  János Áder, and several others. They were all KISZ secretaries. Naturally, that amendment was not approved.

Kim Scheppele was interviewed by The Wall Street Journal and told the reporter that “Hungary now allows investigation of particular individuals without any need to demonstrate a specific reason why every aspect of a person’s life must be reviewed.” She added that “that’s unheard of in democratic states” and that “the new national security law creates an Orwellian landscape in Hungary.”

Some Hungarian activists, quite independently from Kim Scheppele, also immediately thought of Orwell. Members of a group that calls itself “The Constitution is not a game” got together to teach Sándor Pintér a thing or two. About fifteen of them settled on the pavement and read George Orwell’s 1984 all day long. At the end, when they wanted to send a copy to the minister of interior, the policemen insisted that each of them sign the book before they would agree to take it inside the building.

One of the participants, approached by a reporter for Magyar Narancs, refused to talk to him in an area with trees with lots of branches because he was convinced that up in the trees among the branches the authorities place microphones. Maybe yes, maybe no. But the person was wary; Big Brother might be listening in. It says a lot about the atmosphere in Budapest.

Ferenc Gyurcsány’s State of the Nation speech 2013, Part I

About two weeks ago I published the English translation of Attila Mesterházy’s policy speech. Some of you complained about the number of “ladies and gentlemen” in Mesterházy’s speech. In DK circles everybody uses the familiar “te,” including the former prime minister, and supporters call him “Feri.” There is another difference. Unlike other politicians, including Viktor Orbán who is considered to be a good speaker, Gyurcsány has no written text. He talks with the assistance of some scribbled notes and doesn’t have to look at those notes very often. Perhaps you will gain a better understanding of his style by watching a few minutes of the video of his speech.

If we continue as now, the next prime minister will be called Orbán

“If we continue in the same way as now, the next prime minister will be called neither Gordon Bajnai nor Attila Mesterházi but will be called Viktor Orbán. Even though we would have every ground to put an end to Orbán’s governance and, theoretically, we have even the tools to defeat Orbán and his regime. Then, I’m repeating it again: if we go on in the same way as now, we will fail. A great lesson from the past year is that it was not Orbán’s government that caused a surprise. Frankly speaking, he cannot do that any more. The surprise is, if any, that the multitude of democratic people, including the voters, various movements, organisations, the media, a significant portion of intellectuals, who are still brave and committed enough to contravene Orbán, were not yet able to organize themselves, are not yet prepared for a fight ending with victory. But, if we have an influence on something at all, it is evidently the world of opposition. We are not so gullible to suppose that this government is interested in knowing what we are thinking about Hungary, it just does what it wants. We say what we are thinking, we try to show alternatives but, where we really have a great responsibility, where we really have tools, is to organize and train the democratic opposition for the fight, it is to show an alternative against Orbán. We need to do much more than we have done until now.”

The country is tired; there are too many hopeless people

“But still, let me begin with where the country is in the spring of 2013. I can’t say much new compared to the last year, at least not in quality. What we said about the country at that time and what we expected then, is true even today and our expectations have, unfortunately, not been fulfilled either. But we came to assess the state of the nation, we want to speak about the condition of the republic and therefore, let’s summarize, not in too much length, how we see Hungary. If I need to say it briefly, then I say that the country is tired, many, too many people have lost their hope and there is almost no field in the country’s life where we could say that it became a little bit better and more hopeful than was in 2010.”

This is no longer a constitutional state but an autocracy: the will of one single man replaces the constitution

“A debate has been going for a long time about, how to characterize this regime, whether this is still a democracy or already an autocracy, whether constitutionality is still alive. All that happened in the past few days is that this government is amending the fundamental law, said to be as hard as granite, for the fourth time now within one year by a huge package of 26 pages; this may convince even our rightist friends who have not lost their discernment yet that Hungary is no more a constitutional state. Namely, constitutional state means that we decide abidingly what the major frame, institutions and organizations of the state’s operation and the state’s structure are, what our relations to them are. This is what provides stability, the legal system is built on this and we go by this. By today, it has turned out that we do not have to go by the constitution because that may change, if necessary, every day even, but we have to go by the political will behind the permanent change of constitution, which is the will for power of one single person who is called Viktor Orbán. And where the constitution is not the rule but a person’s will, that system is called autocracy rather than democracy. Today, autocracy prevails in Hungary. However, those who want democracy, those who want republic, those who consider themselves democrats, such persons can only oppose this regime. We don’t want to have autocracy. We want to have a free republic with free citizens and those who want to have that, such persons shall require Orbán’s defeat. We are fighting for the defeat of this regime and for restoring the republic.

Decreasing real wages, decreasing consumption, decreasing investment, decreasing unemployment

“Three years ago, this government attained power by promising hope, by promising boom, by promising social justice. Today, the Hungarian economy is more vulnerable than it was in 2010. The shrinking of the Hungarian economy’s performance has been occurring for so many quarters and is becoming more and more serious. The country is in recession. The country’s common cake is decreasing continuously. Never before have so few jobs been established in the first month of the year than just in January 2013. Never before have so many, over 300 thousand people been unemployed without any provision than now. While, theoretically, there is no world crisis, not even in practice, while, of course, Europe has difficulties, but there is not a general crisis in Europe either, in Hungary real wages are decreasing, in Hungary consumption is decreasing and the level of investment is so low that there won’t be any growth in the forthcoming years either. So few homes are being built in this country, less than in 1944 when German troops marched in the streets of Budapest or Makó. We have to face a dark future. The country that obtains its living from investment, the country whose wealth or economy was driven by investment, by capital construction, is now one of the last ones among the investors’ target areas. There is neither investment, nor lending, nor jobs. This is a spiral from which we won’t be able to emerge still for many years.”

The rate of the decline of the Hungarian economic performance is six times higher than the European one: unimaginable depths of poverty and despondency

“The prime minister may say that it is caused by external effects. Partly, and only in lesser part, he is right. The rate of shrinkage of the Hungarian economy is six times higher than the European recession. In this respect, the Hungarian prime minister does not say the truth. Under such circumstances, while touring the country in the past months, we met such a depth of poverty and despondency that I have not seen even for a long time or have never imagined. Poverty has always existed in the history and I suppose it will always exist in the future as well. There will always be people or families, who live on the fringe of the normal human life. Who live from hand to mouth. If I needed to distinguish between poverty of today and that existing many years ago, then I would simply speak about the fact that today there are more poor people and poverty is deeper. I would rather say that earlier, there was at least the hope that you can emerge from it. If nothing else but the hope that it will be better for my children. Today, the hope is lost. Hungary became the country of despondency during Orbán’s governance.”

Only Orbán’s oligarchs are getting richer – the regime introduced the institutionalized corruption

“Those who are getting richer, belong to the world of Orbán’s oligarchs. Poverty has always existed in history and I suppose it will always exist everywhere in the future. But the situation that the political leader and his direct environment, the internal circle of Fidesz world is getting richer by corruption, this is a new phenomenon in Hungary. Such a thing has never happened earlier.”

School was taken away from children, parents and settlements, and only children of the wealthiest families can go to university

“Meanwhile, chaos prevails in the world of education, public education became the site of Christian conservative re-evangelization, the teachers do not know how long they will have their job and from whom they will receive their salary, who their employer is and what is expected from them. School was taken away from children, settlements and parents, they have nothing to do with it, this regime tries to force the free idea of free school to fit to a Procrustean bed, which, from this time on, will evidently not be free any more. While, when we speak about a free country, we naturally also take notice of the fact that there are thousands of different ideas and, since every family and every child is manifold, this manifoldness can be mediated only by manifold schools. That the university’s autonomy is taken away, that by today, universities are, basically, in the state of inoperability. They are not on the verge but in the state of inoperability. That the gates of universities are not opened but closed. That, except for the wealthiest families, almost nobody has the opportunity to acquire such diplomas, whilst the leading power, the intellectuals of the country, those who tailor shape to Hungary of the future will be recruited on the long run from the holders of these diplomas.

Despondency: More people go abroad than after 1956

“The reason for despondency is that more than half a million Hungarian citizens sought and found jobs abroad. More people go abroad than after 1956 and this is the sin of this government because they leave the country who are the most mobile, the bravest and the most venturesome. There are very many young people among them, who are really needed in this country but who do not find any opportunity and hope in Hungary.”

To the executors of the show trials: even bigger rogues than their supporters have collapsed in the past

Meanwhile, not even in a concealed manner, show trials are taking place in this country. I always said: “don’t worry about me, I can protect myself”. I have protected myself as well. The latest decision was made recently, which proved that it was a dirty, unfair calumniation in the autumn of 2006 that the politicians of my government, including me encouraged the police of the republic to use and apply illegitimate methods with the intent of intimidation or revenge. Not even the prosecution of Péter Polt was brave enough to, ultimately, fabricate a legally valid incrimination from this ignoble political accusation. This case was closed a few days ago. This is good. But they keep two of my former ministers, György Szilvásy and Pál Szabó under an unfair and false accusation. Miklós Tátrai is kept under an unfair and false accusation. It is the elementary duty of the democratic opposition to assume solidarity with those whom they want to assassinate in show trials. And I want to say silently and calmly to those who take part in this action that even bigger rogues than their support, Viktor Orbán collapse sooner or later. Their support will also fail and they will then face not a show trial but a great number of fair parliamentary and non-parliamentary proceedings where, after reviewing all papers and all letters, in my hope, it will be proved to the country that today, people are being damaged and bemired in an inhuman, unacceptable proceeding for, even unconcealed, political interests, just in order to smear their political rivals. Those who take part in this action do not simply break the law but are similar rogues as their support.

Hungary became isolated: it fawns upon Central-Asian despots

“Meanwhile, Hungary has become isolated. The country that was, erstwhile, the most European one in this region, today, has an eye to the East. It seeks friends in Baku rather than in Berlin or London. It unscrupulously allows an axe murderer to leave the country and fawns upon Central-Asian despots. Unfortunately, in this situation, in this world, an honest Hungarian democrat should be ashamed of his government rather than his country. We need to admit that we are ashamed of this government and our shame is strong enough that we do not want to live together with it. The country sank to knees, most of the Hungarian citizens lost all of their hopes and feel themselves in a hopeless situation”.

I have seen, how it is when the disappointed right-wing crowd rampages

“To conclude, it would be high time to defeat this government. In 2002 and 2006, I was among those who defeated Fidesz, defeated Viktor Orbán. Even under these experiences I have to say to you that, what we are doing now, where we are now, it will not be enough for the victory and what is at least similarly important, it will not be enough for successful governance. Let me start with the latter, in just 2 or 3 sentences. My friend, the evangelistic pastor Gábor Iványi said a few weeks ago that it was worth ridding ourselves of evil, if only for a moment. It was not an evangelical citation but referred to this government stating that it is worth winning even if the government to be set up as a result of this victory would not be able to govern for a long time. Such a sentence from a gospeller is nice. But from a politician, it is, in my opinion, unacceptable. However, every man shall stick to his trade. We must understand that, in case a multi-coloured coalition government, backed by a small majority, needs to govern within the current constitutional frames, surrounded by party soldiers appointed to the top of agencies that shall be independent from the government, while the country will be in an adverse condition, then we must worry about this government very much that it won’t be able to put in the forthcoming 4 years. I lead a stronger government than that after 2006. I have seen how it is when the disappointed right-wing crowd rampages. I have already seen how it is when, not the whole but part of the state apparatus acts against its government. I can imagine how it is, when everybody, from the president of the central bank to the public prosecutor, from the head of the competition authority to the president of the media authority – and now, I discontinue listing – endeavours to upset the government.”

Hungary’s ruling party and its concept of democracy

A fairly lengthy psychological portrait of Viktor Orbán has been circulating online lately. It is not new. It was put together in 2010, and my hunch is that it’s arousing interest now because after almost three years of the Orbán regime people are becoming curious about the psychological makeup of the man. After all, it is becoming clearer by the day that there is something not quite right with the original founders of Fidesz. Perhaps they are not what people thought they were. Attila Ara-Kovács’s short essay on the young Orbán stirred things up, and I hope that others who know a lot about this period will probe further into the beginnings of Fidesz and the people who were responsible for its founding and nurturing.

The profile is based on Freudian psychoanalysis. To my mind its real value comes not so much from its theoretical hypotheses as from its account, based on contemporary sources and later recollections, of how  self-government in the college dormitory where Fidesz was born functioned. If we can believe László Kéri, the political scientist who was one of their original supporters, four people ran the show in the dormitory: László Kövér, Lajos Simicska, Viktor Orbán, and Tamás Varga. (Varga subsequently spent more than three years in jail for tax fraud.) Orbán, Simicska, and Varga all came from the Székesfehérvár gymnasium. The “gang of four” were the ones who told all the others how they were supposed to behave and what they were supposed to think. Kéri thought that they were an aggressive, exclusive group who ignored the opinions of others and constantly sought out enemies. He compared them to the “Lenin boys” of Béla Kun who traveled the country murdering people. Kéri apparently warned that when Orbán runs this country he “will hang [István] Stumpf and me first because we know who you were once-upon-a-time.” Lately there has been a concerted effort to discredit Stumpf who as a judge on the constitutional court has exhibited too much independence and tends to side with those who rule against the government.

Kéri may have been that perceptive in the late 1980s, but I must say that he showed less acumen when before the 2010 elections he was actually looking forward to a new Orbán government, preferably with a two-thirds majority, because Viktor Orbán in this case will accomplish great things. When the reporter who conducted the interview with Kéri reminded him that Orbán’s first government was not very promising, he optimistically remarked that Orbán is eight years older and therefore wiser. He will be a great prime minister.

Soon enough Kéri had to admit that he was dead wrong. Reflecting on the lost election of 2002, Orbán told József Debreczeni, his biographer, that the only reason he failed was that he was not tough enough.

Critics of the current government tend to gloss over the first Orbán government even though almost all of the present tendencies have their antecedents in Orbán’s first four years in power: extreme nationalism, unification of the nation across borders, accommodating MIÉP (an extremist anti-Semitic party), interference with the media, government propaganda, strained relations with the neighbors. And one could go on and on. General dissatisfaction with, and even fear of, the government led to a record turnout in the 2002 election. And yet eight years later the same crew was reelected with a large majority.

Today, conflicts with the outside world are considerably more numerous than they were between 1998 and 2002 when Hungary wasn’t part of the European Union. But even then Viktor Orbán wasn’t exactly the favorite of foreign political leaders. He had especially strained relations with the United States. George W. Bush refused to meet him, most likely because although he was present in the chamber he acted as if he didn’t hear István Csurka’s (MIÉP) comment after 9/11 that the United States only got what it deserved. Relations with Romania were bad and Orbán managed to tear into Austria as well. Because of his attack on the Beneš doctrine he was not exactly beloved in the Czech Republic and Slovakia. He looked upon Russia as an arch enemy. By the end he had only two friends left: Silvio Berlusconi and the Croatian Franjo Tuđman, whose funeral was boycotted by foreign politicians. But, fear not, Viktor Orbán was there.

A few days ago László Kéri wrote a fairly lengthy critique of the second Orbán government. The essay focuses on the first sentence of the government program allegedly written by Viktor Orbán: “The victor has a job to do, not to insist on being right…. For me this is the motto of modern governance.” And yet, says Kéri, Orbán has been doing nothing else in the last three years but trying to convince everybody that he is right. Always right. While none of the tasks he set forth has been accomplished. He destroyed practically overnight the old structures but was unable to set up functioning new ones.

These criticisms point out administrative failings. But George Kopits, former chairman of Hungary’s fiscal council between 2009 and 2011, is harder hitting. In The Wall Street Journal he bluntly calls Viktor Orbán’s newly constructed regime “a constitutional mob rule” because with the two-thirds majority Viktor Orbán can do whatever he wants. May I remind everybody that George Kopits is an economist with conservative political views, not one of those liberals whom the government accuses of treason against the nation when they criticize his government. Kopits also thinks that “today’s Hungary is eerily reminiscent of the communist regime of János Kádár, under which all public institutions were potemkin bodies that dared not challenge the hegemony of the Politburo.”

Is Kopits exaggerating? Surely not. Just today a lengthy interview with László Kövér appeared in Heti Válasz. Only a summary is available online, but the quotations are telling. “In a democracy there is only one constituent assembly, the people, which at election time receives a mandate through its representatives who via fixed rules and regulations exercise their rights.” The scrutiny of the constitution by the constitutional court “would mean the end of the rule of law and democracy.” He continues: “Who is a democrat? I, who think that the country’s future depends on the free decision of the people which can be corrected in four years, or those who in their distrust of the people expect a small body to read what kinds of messages the God of the Constitution (alkotmányosságisten) sends to earthlings based on the constellations, viscera, and bird bones?” In brief, the constitutional court is not only superfluous but is an outright undemocratic institution. So much for any understanding of democracy by the present rulers of Hungary. If one takes a look at the old 1949 Stalinist constitution, one will find very similar sentiments. Obviously Kövér and company feel quite comfortable with the constitutional arrangement of that dictatorial regime.
